Immigration Evaluations

 

Empowered Mind Therapy Center is here support immigrants’ access to quality mental health care.

We are currently offering the following types of immigration evaluations:

  • This evaluation can show that a qualifying US Citizen relative (Spouse, parent or adult child) would endure “extreme hardship” if their spouse/ relative left the US and they remained here with out them or if relative had to relocate with them to their home country.

  • These are for case that have a court date set for removal (Deportation) of an individual to their home country.

    These evaluations can show how a qualifying US Citizen relative (Spouse, parent or child) would be effected if separated from their spouse or family member.

    A separate evaluation would need to be conducted for each family member.

  • Individuals remain asylum-seekers until their case has been approved.

    This evaluation can be used to focus on how the asylum-seeker was affected by the persecution experiences and if current symptoms are consistent with the trauma reports.

  • Applies to ALL genders, and allows the immigrant to “self-petition” for legal status without relying on the abusive US citizen.

    This evaluation can be used to show the effects of an immigrant who was “battered or subjected to extreme cruelty” by an abusive US citizen.

    Extreme Cruelty = “A non-psychical act of violence or threat of violence demonstrating a pattern or intent to attain compliance or control.”

  • U Visa

    For survivors of a crime committed in the US and the individual suffered physical or mental abuse as a result.

    This evaluation can show that there was a mental harm that was caused as a result of this crime.

    T- Visa

    For survivors of human trafficking or attempted human trafficking.

    This evaluation can be used to show how the survivor was effected by the human trafficking or attempted human trafficking experience.

What To Expect

1. You must already be working with a lawyer and have met the criteria for one of the above mentioned evaluation types.

2. A release of information must be signed so that EMTC can reach out to the law firm to gather details on: when is the court date, who is the “identified client” and when the report is needed by.

3. You will participate in one-two, 90 minute interviews to gather the information needed to complete the evaluation. PLEASE NOTE: This is not a therapy session, if therapy due to trauma is needed, you will be linked to a different provider for ongoing care.

4. Report will be completed 2-3 weeks after last interview is completed.
